Clear, Family-First Terms

1. Acceptance of terms

By creating an account or using HeroKid, you agree to these Terms of Service and our Privacy Policy. You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. As a parent or legal guardian, you are responsible for your child's use of the service.

2. Account responsibilities

• Provide accurate and complete information when creating your account
• Keep your login credentials secure and confidential
• You are responsible for all activity that occurs under your account
• You may create up to 8 child profiles per account
• Notify us immediately if you suspect unauthorized access to your account

3. Credits and purchases

HeroKid uses a credit-based system. Credits are used to generate stories, create avatars, and create pet companions. Credit costs are displayed in the app before each action.

Credit packages are available through supported purchase channels. Prices are as displayed at the time of purchase and may vary by region.

Purchases through Apple or Google are also subject to their respective terms and refund policies.

4. Content and intellectual property

• Stories and avatars generated for you are yours to enjoy within the HeroKid app and for personal, non-commercial use.
• You may not redistribute, resell, sublicense, or commercially exploit any content generated by HeroKid.
• Uploaded photos are processed solely for avatar generation and are automatically deleted within 48 hours. We claim no rights to your uploaded photos.
• AI-generated avatars, pet companions, and stories may vary in quality. Results depend on factors including uploaded photo quality, lighting, and pose. HeroKid does not guarantee specific visual outcomes from AI generation.
• HeroKid retains the right to use anonymized, aggregated data to improve the service. This never includes personally identifiable information.
• The HeroKid name, logo, and app design are our intellectual property and may not be used without permission.

5. Acceptable use

When using HeroKid, you agree not to:

• Upload inappropriate, harmful, or illegal content (our safety pipeline will automatically reject it)
• Attempt to access other users' accounts or data
• Reverse-engineer, decompile, or attempt to extract the source code of the service
• Use the service for any unlawful or unauthorized purpose
• Circumvent rate limits, security measures, or content moderation
• Use automated tools (bots, scrapers) to access the service

Violations may result in account suspension or termination at our discretion.

6. Service limits

To ensure a fair and reliable experience, the following limits apply:

• Up to 20 stories per child (oldest non-favorited stories are automatically removed when the limit is reached)
• Up to 10 favorited stories per child
• Up to 8 avatars per child (4 art styles, 2 poses each)
• Up to 8 pet companions per account
• Up to 5 avatar regenerations per day
• 500 MB offline cache per device

7. Data export and access

Parents may request a copy of their data by emailing hello@herokid.app. We will fulfill your request within 30 days. Exports include account metadata, child profiles, story data, and audit history. Data export requests are limited to one per 30-day period.

8. Account deletion

• You may request account deletion at any time from Settings in the app.
• A 30-day grace period begins after your request, during which you can cancel the deletion.
• You will receive a reminder email 7 days before final deletion.
• After the grace period, all data is permanently deleted: child profiles, stories, avatars, pet companions, payment history, and audit records.
• This action is irreversible once the grace period has ended.

9. Service availability

We work hard to keep HeroKid available and reliable, but we do not guarantee uninterrupted access. Features may change or be updated over time, and planned maintenance may occasionally occur. Story and avatar generation depend on Google AI services (Google Gemini and Google Cloud Vision), which may experience their own outages. We will communicate major changes when possible.

10. Limitation of liability

HeroKid is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law:

• We are not liable for the accuracy or appropriateness of AI-generated content, though we employ multi-layered safety measures
• Our total liability is limited to the amount you have paid us in the 12 months preceding the claim
• We are not responsible for outages or errors caused by third-party services
• We are not liable for any indirect, incidental, or consequential damages

11. Age restrictions

HeroKid is designed for children ages 5–12 under parental supervision. A parent or guardian account (18+) is required. Parental consent under COPPA is required before any child profile can be created or any child data can be processed.

12. Governing law

These terms are governed by applicable law. Any disputes arising from your use of HeroKid will be resolved in accordance with the laws of the jurisdiction in which HeroKid operates. We encourage you to contact us first to resolve any concerns informally.

13. Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify you by email before the changes take effect. Your continued use of HeroKid after notification constitutes acceptance of the updated terms.
